ORDERS AND DELIVERY
An order made via this site ("order") is an offer to purchase a requested item. When we receive a valid request from you, we will accept this order by invoicing you through PayPal via email. Once payment has been received, order confirmation will be sent via email.

We will deliver the product set out in your request ("product") almost anywhere in New Zealand. We do not deliver outside New Zealand, however, an overseas order may still be placed with a New Zealand delivery address. Delivery is made by New Zealand Post from the USA to New Zealand.

We endeavour to deliver your order within 5-10 working days of us receiving the order at our US freight forwarding address, although this timeframe is an estimate only. If we are not able to supply the products or there is likely to be a significant delay in making delivery (e.g. because the product is out of stock or the delivery is to a rural/remote location*), we will notify you as soon as reasonably possible after we become aware of this, in which case you may cancel the order (or any part of it) and you will receive a refund (including the applicable delivery charges) in respect of those products which will not be delivered (if any). We will not otherwise be liable to you for any damages, costs or expenses of any kind, suffered or incurred by you due to the order not being fulfilled or the products not being delivered within the anticipated delivery time.

The anticipated delivery charges (if applicable) will be notified to you when you complete the order, although in some cases the actual delivery charges may be higher (e.g. if the products delivery is to a rural/remote location). We will notify you if the actual delivery charges are higher than those anticipated, in which case you may cancel the order (or any part of it) prior to delivery and receive a refund (including the applicable delivery charges) in respect of the cancelled order.

Cancelling Orders: FindSend reserves the right to cancel orders for any reason or to cancel the purchase agreement after order confirmation, including (without limitation) where Consumer Direct believes the order to be fraudulent or constitute a misuse of a promotional or marketing activity or where an error has occurred including but not limited to errors relating to pricing. If we do cancel your order or purchase agreement, we accept no liability for any resulting damages or costs suffered by you, however we will refund the purchase price to you (where it has already been paid).

PAYMENT
All payments are through PayPal. By using PayPal, you agree to accept all PayPal's Terms and Conditions. PayPal accepts all major credit cards, including Visa, MasterCard, American Express and Discover. Debit Cards and Bank Transfer are also accepted by PayPal.

At this stage we do not accept Gift Vouchers, Cheques or Internet Banking as methods of payment.

All transactions will be billed in $US. You will need to submit your credit or debit card details when you receive a PayPal invoice from FindSend. Using PayPal's secure checkout, you will need to pay the invoice. A confirmation email will then be sent to confirm the purchase and the value of your order.

PRICING
The price of a requested product, will be invoiced in US dollars and will include US sales tax. Delivery cost will be invoiced in US dollars and New Zealand GST if applicable.

Pricing errors: Although we do our best to ensure prices stated by our shoppers are accurate, errors do occur from time to time. Where a pricing error occurs (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated, and reserve the right to cancel your purchase or request.

RETURNS & REFUNDS
Returns and refunds are available for orders that are incorrectly placed or delivered by our shoppers. If you wish to a get a return or refund on an item because you have changed your mind, we will supply you with all information necessary for you to arrange your items return yourself, at your own expense.

DELIVERY AND SHIPPING
We endeavour to deliver all requested items within 5-10 working days of us confirming its arrival at our freight forwarding facility in Los Angeles, although this timeframe is an estimate only.

If we are not able to supply the products or there is likely to be a delay (e.g. because the product is out of stock or the delivery is to a rural/remote location), we will notify you as soon as is reasonably possible after we become aware of this, in which case you may cancel the order (or any part of it) and you will receive a refund (including the applicable delivery charges) in respect of those products which will not be delivered (if any).

Delivery Estimates:
FindSend makes every effort practical to ensure that delivery timeframes given are accurate. However the delivery times stated for our service assume that the stock availability information provided by our suppliers is accurate and that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold FindSend liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.

Physical delivery address required as delivery is by courier.

We cannot deliver to a P.O. Box address so please provide a physical address.

Delivery will be by courier or freight forwarder. An email will be sent to you when the goods are dispatched to enable you to track and trace your order.

Please ensure you have your order delivered to an address where someone is available to sign for it. If you are unavailable to sign for an item when our courier calls, we will leave a card at the delivery address so you can arrange for the re-delivery or collection of your goods.

Addressing

The risk of any loss of, or damage to, the products will pass to you on delivery.

Addressing: If a product is found to be mis-addressed by FindSend then FindSend shall be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address, then FindSend will not refund or resend the product and all responsibility for correcting delivery will be borne by the Customer.

Delivery only within New Zealand
An overseas order may be placed with a New Zealand delivery address. Currently, we do not deliver outside New Zealand.

Additional delivery charges
If applicable, estimated delivery charges will be displayed when you complete your order, although in some cases the actual delivery charges may be higher (e.g. if the products are large/heavy or delivery is to a rural/remote location).

We will notify you if the actual delivery charges are higher than originally estimated, in which case you may cancel the order (or any part of it) prior to purchasing, and receive a refund (including the applicable delivery charges) in respect of the cancelled order.

TERMS
Content
We endeavour to ensure that any content will be current, accurate or complete when you access it. However, we will take steps to correct any error or inaccuracy in any content which is brought to our attention within a reasonable time.

This site may from time to time contain content provided by third parties and links to third party sites. This is provided for your convenience only and we are not responsible for any third party content on our site or any site to which our site contains links. The inclusion of any such content or link does not imply our endorsement or approval of any linked website or any association with its owners or operators.

You must make your own assessment of the suitability of the content for your own purposes. You are solely responsible for the actions you take in reliance on the content on, or accessed through, this site. We may change the content on this site at any time without prior notice. Force Majeure
We will not be responsible for any delay or failure to comply with our obligations under these terms of sale if the delay or failure arises from any cause which was beyond our reasonable control. This does not affect any of your statutory rights.

Consumer Guarantees Act
If the products are subject to the New Zealand Consumer Guarantees Act 1993 ("CGA"), you may have statutory rights and remedies which are not excluded nor limited by the above provisions unless you are acquiring the products for business purposes, in which case all of the above exclusions and limitations will apply and the CGA will not apply.

All Liability Excluded
To the extent permitted by law: all warranties, representations and guarantees (whether express, implied or statutory) are excluded, including without limitation, suitability, fitness for purpose, accuracy or completeness of this site or the content on or accessed through it; and we will not be liable for any damages, losses or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by you in connection with your access to or use of this site or the content on or accessed through it.

If your use of this site or its content is subject to the New Zealand Consumer Guarantees Act 1993 ("CGA"), you may have rights or remedies which are not excluded nor limited by the above. If you are using this site or its content for business purposes, the above exclusions and limitations will apply and the CGA will not apply.

Additional terms and conditions may apply for certain products or services which may be available through this site and any such additional terms and conditions must be read in conjunction with these terms of use.

Amendments
We may amend these terms of use from time to time, so you should check and read these terms of use regularly. By continuing to use this site after any such amendment, you are deemed to have agreed to the amended terms of use.

Jurisdiction and Governing Law
These terms of use and any matters or disputes connected with this site will be governed by New Zealand laws and will be dealt with in New Zealand courts.
